All users, both buyers and sellers, must comply with the provisions of this section in a supplementary and additional manner to the provisions of applicable law, especially the provisions of the Spanish Civil Code and Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (TRLDCU).

CONTRACTS BETWEEN USERS – TRANSACTION CONDITIONS

Every user who places an order on cardcrack.com acquires a formal and firm commitment to complete the order, through its full payment, constituting a legally valid contract between the buyer and the seller. Failure to pay for one or more orders will be considered a breach of contract with all applicable legal effects.

The purchase price must be paid within one week after the establishment of said contract. The seller will have the right to cancel the order after this period has expired.

The seller is obliged to ship the order within one week after payment is made. Furthermore, they must ship it using the shipping method chosen by the buyer. The buyer will have the right to cancel the order after this period has expired at no cost.

The respective price of the item is the final price, including VAT, IGIC, or any other applicable indirect tax. Shipping costs are not included in the price of the items.

The buyer is obliged to provide the seller, when placing an order, with a complete and reliable address to send the products. Non-receipt, late receipt, or damage of any kind due to the omission of this duty will be the buyer’s responsibility.

Repeated breach of these terms by any buyer or seller may result in the user’s expulsion from this platform.

SHIPPING METHODS AND PAYMENT METHODS

Sellers will have the following shipping methods enabled by default: Ordinary letter, Certified letter, and Blue parcel (Paquete azul), all of which are Correos España products. Additionally, each seller may add custom shipping methods, being responsible in any case for their correct inclusion and the prices that this additional system yields for any cart. The seller must assume any loss caused by errors or false calculations caused by shipping methods other than those offered as standard by cardcrack.com.

All shipping methods included on cardcrack.com have a reasonable delivery time, usually between 2 and 5 days for the different Correos products.

Shipping costs will depend on the following variables: shipping method, weight, and order value. The actual and final shipping cost will be calculated in real-time by cardcrack.com specifically for each order placed by the customer.

The standard shipping costs offered by cardcrack.com will be calculated by adding a surcharge of between 0.50 and 2.00 euros, depending on the shipment’s weight, to the official Correos España rates, which can be consulted at the following link:

ORDER CANCELLATION

Without prejudice to the provisions of the previous section, every user may, before the order is shipped, request the seller to cancel it for any reason. The seller should facilitate its cancellation in any case to provide the best possible customer service.

Sellers do not have a legal obligation to agree to the cancellation when acting in legal traffic as non-professional natural persons (private individuals).

Any seller acting as a professional, whether a natural or legal person, will have the legal obligation to facilitate cancellation in all situations, as a recognized right of the buyer, who in these cases will have the status of a consumer.

This cancellation policy will not apply in the case of custom-made items, items obtained by commission, or those whose cancellation renders all or some of the products it contains useless.

RETURNS AND REFUNDS

The Law (TRLDCU) provides consumers with a right of withdrawal for the provision of the service provided as well as for distance contracts that do not involve any cost. In accordance with this law, we inform you below about the right of withdrawal.

This right is only applicable to natural person customers (individuals) who establish a contract for the purchase and sale of products or services acquired or provided at a distance. Professional or commercial customers may not use this right. Likewise, the seller must have the status of a professional or entrepreneur for this right to be enforceable by the buyer, not being applicable in any case when both parties are non-professional natural persons.

The right of withdrawal implies the possibility of terminating the purchase contract within a period of 14 days, without the need to state any reason, with the restitution of the items and payments.

The seller, if the right of withdrawal is exercised by the buyer, must refund all payments received, including shipping costs, once the contents of the order have been received back and are in perfect condition. The shipping costs caused by the return of the product by the buyer to the seller will be borne by the buyer.

In both cases of order cancellation and returns, the seller must proceed to refund the payment by the same means through which the order was paid. If the payment method used was intermediated by cardcrack.com, they must request assistance from the support team to proceed with said refund, authorizing this entity to pay the corresponding amounts to the buyer on their behalf.

Returns made by buyers must observe the utmost diligence, maintaining the condition and packaging of the products in their original state, and returning them with the greatest guarantees and protection possible, in order to be eligible for a full refund.
